Possible Class Action Lawsuit For UT Health

While digging through a stack of my personal medical records, I think I may have found common ground for a class action lawsuit. I believe i have found a compelling argument for specifically UT Health East Texas Hospitals. Evidence proving that specifically Dr. Susan Mcmullen neglected her fiduciary duties as a primary care provider to treat patients for Class lll Obesity (morbid obesity) if the patient doesn’t meet criteria for Bariatric surgery services provided by UT Health East Texas Hospitals.

I am not any type of attorney or a doctor, but I do see what is in my medical records and facts about Class lll Obesity.

  • FACT is that most doctors and hospitals agree that obesity puts patients at significant risk for serious health problems _ such as heart disease, diabetes, cancer ect. Any respected physician should be significant proof as to the severity of Class lll Obesity.
  • FACT is that UT Health East Texas Hospitals do offer service for Class lll Obesity, but the services UT Health offers are only available for patients that have already been diagnosed a serious weight related illness. So a healthy person that is classified as Class lll obese, do not qualify for the bariactric service provided by UT Health East Texas Hospitals.
  • FACT Dr. Susan Mcmullen never referred me to any type of weight specialist for Class lll Obesity treatment outside of the UT Health East Texas Hospitals system.
  • FACT there are a large assortment of treatment options and specialist that I did qualify for and that my health insurance would have covered. My primary care doctor neglected to inform me of available specialist and treatments available to me, that she had the fiduciary duty to inform me about.
  • FACT during at least 1 visit i remember specifically asking my primary doctor Dr. Susan Mcmullen about GLP-1 medications and she informed me that I did not qualify even though I was classified as Class lll obese. She did not offer other available treatments during that visit.

It is my belief that Dr. Susan Mcmullen would have referred me to UT Health East Texas Hospitals for weight management, dietitian services, or prescription weight loss specialist _ if UT Health had the departments for these treatment.

What Proof Do I Have To Make These Class Action Lawsuit Claim Public

  • I have my medical records because that’s all I need.
  • I also have this website. UT Health knows about these serious claims. If they were FALSE claims could make me take them offline. Since my claims are TRUE, UT Health is unable to have me remove them.

My first visit with Dr Susan Mcmullen was on February 8, 2022. My BMI on my first visit was 48.97 and logged in at 294lbs and 4oz. I was a Class lll obese, but other than my 48.97 BMI I was healthy with no major health issues. I did not qualify for Bariatric services.

My last visit was with Dr Susan Mcmullen was on July 23, 2025. My BMI was 44.10 and logged in at 265lbs. I was suffering the effects of Thiamine deficiency caused by the diet pill “Phentermine” she prescribed to me without knowing about serious side effects. I was not made aware of any other medical options to loose weight available to me.

On September 24, 2025 I was diagnosed with breast cancer. So while under Dr Susan Mcmullen’s care, my Class lll obisity went untreated because I didn’t qualify for Bariatric treatments provided by UT Health. Almost 3 years with her as my primary care provider, and now I have breast cancer.

Of course I was referred to UT Health East Texas HOPE Breast Center in Tyler for diagnostic testing. The UT Health breast center is 55 miles / 1 hour 6 minutes from my home. Texas Health Kaufman _ Breast Center offers the exact same services i received 30 miles / 34 minutes from my home, but I was not referred to the closer facility.

More details that should be considered from my personal medical records. Dr. Susan Mcmullen did send me a referral to UT Health East Texas Hospital orthopedic surgeon Alireza Behboudi DO for treatment when I tore my meniscus. He performed a knee Arthroscopy for the repair. Dr. Behboudi’s assistant Neal Burgess PA-C did suggest weight loss after the surgery to help with future knee problems.

Dr. Mcmullen did prescribe phentermine 37.5 mg tablet to me as 1 pill in the morning before breakfast after I told her Neal Burgess PA-C suggested I loose weight for knee health. She said it would help loose weight. That pill depleted my body of important nutrients including magnesium and thiamine. She was unqualified and negligent in giving me that medication because she was unaware of “severe side effects requiring immediate medical care” as noted on MedlinePlus.gov If my diet pill was administered by a qualified weight management management professional, outside the UT Health East Texas Hospital my outcome would have been much safer.

As UT Health East Texas Hospitals do not offer these weight management services, they were not provided to me by my primary doctor.
