This office visit is very telling looking back onto the time line of events. As we are aware of now _ I was a victim of malpractice because Dr. McMullen didn’t follow FDA guidelines for the Pantoprazole. So in May of 2023 I was starting to feel a lot of the long-term side effects of the drug.

I called Dr. McMullen’s office on 5/5/2023 asking for an appointment because of extreme pain in my back. Hannah T. suggested some over the counter medications and a heating pad for the pain. The earliest appointment I could get in to see McMullen was 3 days later.

Reason for 5/8/23 appointment is pain, numbness and tingling and fatigue.

These are the actual notes in my medical record: “Having problems x months in the back and has itchy spots, tingling patches, blotches/no rashes and numbness on inside of left foot/great toe. ?mole problem. Had scraped not dug out. Then week ago started with back pain in the small of the back , not a true radiculopathy , patch pins/needs on R, pain on the left. Using the Tylenol, naprosyn, not help. If take shot of liquor helps, but not want to do that. Pain x wk. No new or different activities. Work is physical, no Ah-ha moment. Sleep overall ok”

The treatment plan for Back pain of thoracolumbar region is to add new prescription medication

  • gabapentin (NEURONTIN) 300 mg capsule; Take 1 capsule (300 mg) by mouth at bedtime. Gradually increase to 3 times a day as tolerated.
  • naproxen (NAPROSYN) 500 mg tablet; Take 1 tablet (500 mg total) by mouth 2 (two) times per day if needed for mild pain (1-3) (pain). Not Supposed to have NSAIDS

A “Hand Out” was attached to MyChart for home exercises for my back.

The same “Hand Out” attachment also includes a diagram and some educational information about the anatomy of a back. The information is labeled as Low Back Pain in Adults.

The Treatment Plan For The Paresthesias

Says gabapentin and naproxen so these 2 prescriptions are supposed to help the back pain and paresthesias.

Treatment Plan For The Chronic Fatigue

Test results from this days clinic visit will be listed at the bottom of this page. These blood test are important and would have helped if Dr. McMullen had actually used the test results to treat my condition.

There were some other blood test ordered that don’t really look like they really go with this office visit. They look more like random or routine blood test.

I did the blood test as ordered, but I never told McMullen that I might have been exposed to Hepatitis C. I just did the test because she said I needed it. – Whatever

Test results from this days clinic visit will be listed at the bottom of this page. I’m not sure as to why these blood test were separated from the blood test for chronic fatigue. The symptoms for diabetes include fatigue, and nerve issues.

My annual mammogram was also ordered for this visit. I went in for pain, nerve issues and fatigue. This office visit looks more like a standard annual exam and not a sick visit. Other that getting my blood test and my annual mammogram _ Dr. McMullen’s remedy for my back pain is to start taking gabapentin and naproxen.

There Is A Notable Error In This Medical Record

Dr. McMullen did not note this in the medical record, but looks like she ordered some Xrays of my spine on this day. The x-rays were taken as soon as I left her office on this day. I do not know why the xray orders are not in this medical record. I will post the x-ray results below the blood test results.

Some of the abnormal results in these test results can be linked to long-term used of Pantoprazole. The information was there for all of my health care providers to see. For some reason my health care providers couldn’t figure out what was wrong with me.

The Low HDL Cholesterol could indicate a variety of issues. The issues range from unhealthy diet to kidney disease. It would be reaching too far to point the indication in any one direction.

Spine X-Ray Results

XR THORACIC SPINE 3 VWFINDINGS: The vertebral body heights are normal. There is some minimal degenerative disc disease within the mid to lower thoracic spine. Minimal dextrocurvature mid thoracic spine with levocurvature involving the lower thoracic spine. There are no evidence of fractures.
XR LUMBAR SPINE 4+ ViewsFINDINGS: The vertebral body heights are well maintained. The disc spaces are well maintained. There is a minimal diffuse levocurvature lumbar spine. No significant change in alignment is seen between the flexion and extension views. Prevertebral soft tissues are unremarkable.

Dr. McMullen’s Response To The Blood Test & X-Rays

Dr. McMullen sent me a message in my chart telling me that I didnt have diabetes or Hepatitis C. She said that good HDL Cholesterol was low and that I should increase exercise and add more fish to my diet to help raise my good Cholesterol. She said that all of my other blood test were “OK”.

She said that my X-rays showed “minimal degenerative changes” and that I need to continue with the home back stretches from the “hand out” attached in MyChart.

Like my only issue was that I needed to increase my good cholesterol.

In the moment back in 2023, I had no reason not to trust Dr. McMullen’s medical advise. I believed her because she was my trusted doctor. I trusted her with my life.

How This Medical Records Proof Of Medical Malpractice By Dr. McMullen?

Im going to start with the blood test. As a patient that doesn’t know medical stuff, we trust our doctors to interpret blood test. I trusted Dr. McMullen when she said that the only issue was my good cholesterol was too low.

Now when I think about it. These blood test were created by doctors and scientist that do know medical stuff. ABNORMAL means NOT NORMAL also meaning _ not the way its supposed to be. The label of ABNORMAL was done by other medical people _ not myself as the patient.

Then the reason of the office visit : Pain, Numbness and tingling, Chronic fatigue. I called in on 5/5/2023 to get an appointment. I had to wait 3 days for the next available appointment. I attended the appointment 3 days later, because the issues were not resolved taking OTC home treatments.

Dr. McMullen’s clinic visits generally last 15 – 20 minutes. So how in the world did she do an exam for Pain, Numbness and tingling, Chronic fatigue and give me the medical care that I waited 3 days for… Then still have time to add on Hepatitis C, diabetes mellitus, annual mammogram and to attach a generic back “Hand Out” to my medical record.

I don’t think my health was priority for Dr. McMullen during this clinic visit. The fact that she didn’t even bother to mention the x-Rays she ordered of my back on supports that she wasn’t thinking of my medical complaints during the office visit.

On January 31, 2023 less than 4 months before this appointmentment Dr Srikar Reddy Mapakshi said for me to avoid the use of NSAIDS. He put this in my medical records on 1/31/23, but I didn’t read them till after I left Dr. McMullen’s care. APPARENTLY DR. MCMULLEN DISAGREED Read About Dr. Mapakshi’s EGD procedure here

The Medical Proof Of Malpractice For This Visit

So I’m not a doctor. I’m not familiar with medical terms. At the same time, I’m not a complete idiot. I understand what has happened to me and how it happened.

I will not attempt to create an explanation using medical terms. I wouldn’t want to make a simple medical term mistake and have that mistake discredit my claims.

Dr. McMullen prescribed pantoprazole on 2/8/2022 so on this specific day I had been taking pantoprazole daily for 15 months straight. I stayed with Dr. McMullen as my primary care provider until August 2025. I continued to take pantoprazole daily the entire time McMullen was my care provider.

This appointment is when side effects were just becoming painful in 2023. Over time things get much worse, because it went ignored and untreated.

Whats Being Done About This Medical Malpractice?

  • I have sent this information and much more to UT Health East Texas and Ardent Health since they own 70% of the hospital.
  • This resulted with a risk manager at the UT Health Athens sending me a letter trying to excuse the malpractice. I told her that I was going to report each of the doctors that treated me in 2025 to the Texas Medical Board. She did tell me that I had the right to report them to TMB.
  • My medical records for my Dr. McMullen clinic visits have also been changed / altered to hide malpractice. I told UT Health East Texas / Ardent Health that my medical records have been illegally changed, they asked me to send them the before screenshots. They said they can return my medical records to their originals if I signed a paper giving them permission to change them.. So I declined their offer and decided not to sign their authorization form.
  • I also did report Dr. McMullen to the Texas Medical Board. I wasn’t able to send in documents with my original TMB complaint. So Dr. McMullen told the Medical Board that I was informed of side – effects / NOT TRUE. While I’m not 100% what McMullen told the medical board _ i’m 100% sure that she didn’t tell them what really happened.
  • The medical board said they didn’t see cause for disciplinary action, but they did give me information for how to appeal. The appeal information included the process for submitting documents and proof. Of course, I appealed their decision and continuing to send in documents and information about how Dr. McMullen’s care didn’t meet minimum medical standards. The medical board will review the documents and proofs I have sent them in the near future.

UT Health East Texas / Ardent Health has chosen to do nothing. Dr. McMullen is currently still caring for patients at UT Health East Texas Hospitals owned by Ardent Health. So apparently she hasn’t broken any kind of hospital policies and her medical care is still being backed by UT Health East Texas / Ardent Health. I guess this is how they run their hospital system.
