What Passes For Supporting Evidence To The Texas Medical Board

What passes for supporting evidence to the Texas Medical Board is a bit of a mystery. Since this is a fairly recent turn of events, I want to spend more time on the complaint I submitted to the TMB.

To make things as clean an simple as possible, I am pulling off a small piece of the complaint for this publication. I just want to make sure that this gets everyone’s full attention.

What Was In My Medical Board Complaint

So in this complaint, I said that Dr. McMullen did not follow Food And Drug Administration guidelines for the medication Pantoprazole. As a result of not following FDA drug label information, I almost died.

LEGALLY doctors are not required to follow FDA drug labels in the state of Texas. The FDA labels are just for medication information. The FDA will always say “recommended”, “suggested”, because doctors can prescribe medications to their patients however they like.

The issue here is that IF Dr. McMullen had followed the FDA recommendations that are published in the Pantoprazole I wouldn’t have almost died.

So Dr. McMullen freely chose it ignore the FDA Pantoprazole drug label warnings. And since those warnings were completely ignored – Dr. McMullen was unable to recognize the side-effects from the PPI. The FDA Pantoprazole drug label has published in great details the same exact side effects I suffered for MONTHS.

  • While doctors are not required to follow FDA guidelines, doctors are required to know about any and all possible side-effects of every drug they prescribe to a patient.
  • So if something like a doctor killing their patient because they chose to completely ignore creditable medication information – The doctor can be held accountable for their actions

Proof Support My Complaint Sent To Texas Medical Board

This part of the complaint was fairly difficult to prove as a patient, but I think I did it sufficiently. I’m sure a doctor or attorney could have done it better – but I did prove it with documents.

My first proof was done by over the how the FDA Pantoprazole drug label warns of specific side effects. The drug label even puts the details in somewhat of a time frame. See the FDA Pantroprazole warnings HERE.

I sent the link to the FDA site for Pantoprazole on January 15, 2026 at 9:33 PM to appeals@tmb.state.tx.us as instructed by the Texas Medical Board.

So with sending some text information like this – then sending them a link to the FDA Pantoprazole warning – I have just reasonably proven the possible severe side effects of the PPI. I could likely print this FDA Pantoprazole drug label and use it as a court document with any issues. This public information is available to everyone and is a trusted source of information.

I have just proven that the information is my complaint should be considered, just by sending the link with the FDA information.

Now I Need To Prove That Dr. McMullen Was Negligent By Ignoring The FDA Information

So in the FDA Pantoprazole warning, it says that the (Protonix):

  • Recommended 8 week treatment cycles
  • Can cause severe side-effects if used long-term
  • It says that doctors should monitor patients for side effect if using long-term

So I turned in my medication history proving that I had been taking Pantoprazole non-stop for 2.5 years. This proves that I was given the drug “long-term”.

I also turned in some of my medical records going over some of my visit with noted side-effects of Pantoprazole. But my medical records did not have the symptoms as a side-effect of anything. They were just random nerve and pain issues, because that how they started.

I sent over a huge email with 12 different documents of proof and lots of text explaining what happened on Febuary 5, 2026 9:59 PM to appeals@tmb.state.tx.us.

I think adding all 12 documents to this article will be a bit too much for 1 read. So I will include most of the text details that I sent to the Medical Board. I will place 1 of the proofs I sent with this text at the beginning of the text and place another proof I sent on this day at the bottom of the text. I have many more documents of proof to the text.

Remember that the Texas Medical Board seen this with the proofs and said that I lacked supporting evidence. Complaint was CLOSED without any kind of investigation.

Details Sent To Texas Medical Board on 2/6/26 Supporting My Dr. McMullen Complaint

Before I get started with all of the medical stuff, I want to start with telling the medical board that Dr. McMullen had my medical records changed illegally to cover up her malpractice. I have Attached image name (TMB6) please see that image for referencing these details. This image is one of my best images for McMullen changing my medical records to hide her malpractice. Please see the area labeled (Patient Active Problem List) at the top of the page. See the list of active medical issues – just look. Then move down to the (Patient Active Problem List) near the bottom of the page and see the exact same active medical issues listed above in the same image_ the difference in the 2 list is that 1 of the list was manually typed into the record while the other list is automatically inserted for doctors to save time a streamline the record keeping process.

The legitimate (Patient Active Problem List) is the list at the bottom of the page. This list automatically includes the date of diagnosis beside the medical issue, as seen in this image.

So the illegally changed medical records can be identified by the automatically included date of diagnoses dates to the immediate right side of each medical issue. The fake medical records do not have the diagnosis dates beside the medical issues.

My Medical records from Dr. McMullen have been illegally manipulated starting on 4/3/2025 and include records on the dates of 4/25/25, 6/25/25, 7/16/25, and 7/23/25.

This specific medical record is from 4/25/2025 and its still posted in MyChart. I did tell UT Health that someone falsified my medical records to cover up malpractice. They said if I sign an paper and send them a screenshot of the issue _ they would correct the medical record. I told them I wasn’t signing anything and to not change anything.

Changing my medical records in this way very illegal for a doctor to do _ especially since I almost died. Dr. McMullen changed my records to cover up how her medical care almost killed me.

This image may or may not be enough proof of my medical records being changed for the medical board. I can and will willingly provide all of my medical records for inspection for the board if it’s what’s needed. Or y’all can ask Dr. McMullen to send a medical record from her office  4/3/25 or later and a medical record from her office before 4/3/25. I can let the medical board access MyChart also if that’s a better way.

I have not yet done so, but I do intend to send the changed medical records to law enforcement to press charges. I’m just not exactly sure what agency I need to make a criminal report to. I know its illegal so that means someone is supposed to prosecute faking medical records in a criminal court.

*Dr. McMullen became my PCP on 2/8/2022. On 2/8/2022 Dr. McMullen prescribed to me Pantoprazole for “chronic gastroesophageal reflux disease”. I told her heartburn woke me up at night, and that I would have to take tums to go back to sleep. I told her that I had taken the over the counter Omeprazole and that seemed to help with he heartburn. She prescribed the Pantoprazole and diagnosed me with “chronic gastroesophageal reflux disease” during 30 min new patient appointment. I took the Pantoprazole everyday thinking that it was like Tums. I thought it was a heartburn prevention pill, so I wouldn’t need to take tums. I never know what a Proton Pump Inhibitor was until 2026. I continued to take the pantoprazole daily for years without even talking about it with Dr. McMullen. She never talked to me about getting off the pantoprazole and she never told me about any kind of side effects. I was never told that Pantoprazole should be used as a temporary medication or the possibility of it hurting my body.

*BUT of course, Dr. McMullen will disagree with this fact. She will probably say she told me about the drug and warned me. She lied to the medical board when she said that she went over Phentermine side effects, so I am expecting her to do the same for the Pantoprazole. Dr. McMullen and I never recorded our appointments with video or audio so its my word against hers on this fact. Being that the medical board are doctors and I’m not _ I can expect the board to believe her when she lies and said that she told me about taking Pantoprazole. It is what it is _ whatever.

Moving on to the next FACT..

*Shortly after starting Pantoprazole, I started having severe abdominal cramps. I remember the cramps very well because I literally thought I was dying. I had Charley horse cramps in my upper left abdomen (below my ribs) to where I know now as being my intestines. The pain was an extreme 9-10 and felt just like a Charley horse but was in my upper left gut. The pain also seemed to me very specific in shape and size. It was round pain and about the size of a softball. It was a very specific pain. Exact same location, shape, size, and felt just like a Charley horse but in my intestines. I seen Dr. McMullen about this pain on 3/23/2022.

* During this clinic visit McMullen ordered CBC w/ Auto Differential / Comprehensive Metabolic Panel / Urine test / CT of Abdomen with Contrast. The CT with contrast turned into a sonogram. The radiologist report for my sonogram said that I had fatty liver and a few gallstones. but nothing else was noted with that report. The Urine test came back as Abnormal with traces of blood. Comprehensive metabolic panel came back as normal. The CBC w/ Auto Differential came back as ABNORMAL. This test came back as “RBC high”, “Eosinophils high”, “Basophils High”, “Lymphocytes High”. All of this is documented in my medical records by Dr. McMullen. The test results are right there in MyChart.

* I did Google all of those abnormal elements of the blood test for that day and they can all be linked to the Pantoprazole. The traces of blood in my urine can also be linked to the Pantoprazole. BUT Google is not a doctor. Google isn’t even a reliable information source, I just use it as reference guide. Dr. McMullen sent me a note in my medical records through MyChart telling me that my “Chemistries, blood count and urine were all OK” and I believed her at the time. She was my doctor and I trusted her medical treatments. Dr. McMullen still never spoke to me about these severe abdomen pains possibly being a side effect of the protonix.

* McMullen really cant deny any of this particular information, because its right there in my medical records written by her. Was her treatment below standard in this particular instance? I really don’t know. I’m not a doctor. Is this what they teach in medical school?

* I have attached a picture (TMB1) of Dr. McMullen’s note to me in MyChart about the test results. The image doesn’t really prove much, but it will prove a lot more of Dr. McMullen denies these facts.

Moving on to the next FACT..

*5/9/2022 still taking the Pantoprazole everyday as prescribed, I did my well woman’s exam. As noted in the medical records written by Dr. McMullen, I told her about breakouts on my body. I believe that on this specific visit, I had a big boil on the outside front of my groin area. I told her that I was getting breakouts on my bra line under my breast and in my groin area – but not inside my vagina. Dr. McMullen prescribed me Doxycycline for the breakouts.

*Again I googled Pantoprazole and boils and there are some links. I believe the FDA also list skin irritations as a possible side effect of Pantoprazole. Dr. McMullen still never mentioned that what I believed was a daily antiacid could cause skin breakouts.

*I trusted Dr. McMullen’s medical treatment and started taking the Doxycycline like she said. I continued to take the Doxycycline daily until 11/8/2022. From what I have read about Doxycycline, long-term side effects start appearing after 8 weeks of use. This medication didn’t work on my breakouts in the 6 months I was taking it_ so on 11/8/2022 Dr. McMullen changed it to sulfamethoxazole-trimethoprim.

*I really don’t know how Dr. McMullen can deny I was having some skin irritations and she prescribed medications for the skin issues multiple times. My medical records can prove exact dates and issues as noted here. I will be more than happy to supply copies to the medical board if y’all would like to take a more thorough look. _ never know, I might have missed important details _ someone with a medical background might see more.

Moving on to next FACT..

So as listed as a long-term side effect of Pantoprazole _ I started having nerve / neurological issues. Since I’m not a doctor, I didn’t recognize them as being “neurological” in nature. Just weird off the wall stuff that didn’t seem like much of anything at the time. I was the patient experiencing the issues _ and I was concerned enough to take the issue to my doctor.

Again I am no doctor, but looking at these issues in my medical records now _ the symptoms are very obvious. In all fairness, I have read the FDA label information and warnings now. Since I am aware of the possible issues with the drug, I can easily see them even as the patient. BUT Dr. McMullen should have already been aware of the FDA label and possible side effects, so she should have seen the side effects as soon as they appeared. I still was never talked to about possible side effects of Pantoprazole. As far as I knew I was taking a harmless antacid in place of my Tums.

*I will be listing a few clinic visits with the neurological symptom I told McMullen about. These dates and visit information is all noted in my medical records written by Dr. McMullen. If the medical board would like to see any of these medical records_ please let me know and I will send them over ASAP.

Transient. But then that evening fever/chills, weak. So went to Kaufman and was found to have UTI. Was started on abx, but then received a call on 7/18 that blood cx were positive for E coli and to come to hospital asap. So went to UTA , was admitted for same. Started on empiric IV abx and then transitioned to oral. Follow up blood cx negative. Clinically felt much improved. Never had classic uti symptoms. Prior to this had been having issues with lumbar spine, clonus in the LLE, weakness of the LLE . Was worse with physical therapy. Moving on to next FACT..

*Dr. McMullen was my PCP for years. After I almost died, my medical records involving my medical care from Dr. McMullen was altered, changed, edited or manipulated to hide her poor treatment. While I did not physically see Dr. McMullen make the changes with my own eyes _ someone that has the ability to edit my medical records and Dr. McMullen’s notes changed the records. The messages I sent Dr. McMullen through the MyChart messaging system were also deleted. Very specific messages between myself and Dr. McMullen that could prove extremely poor health care. *So my proof of the manipulation of my medical records vary depending on the day and information in the records. *On 4/20/2022 I was diagnosed with gallstones by a radiologist report. The report was published to MyChart and is still there, but that gallstone diagnoses was never added to my medical records as a “current issue” or “diagnosis”. 2 days after the radiologist uploaded the gallstone diagnoses to MyChart I had a clinic appointment with Dr. McMullen. No mention of the gallstones in my medical record past the radiologist report. I don’t think I almost died of gallstones, but I’m absolutely 100% sure that my medical records are incomplete. All of the doctors that provided me with medical services referred to my medical history. The gallstones were not part of my medical history.*4/20/2022 The same radiologist that reported to my PCP that I had gallstones, also reported that I had a “fatty liver”. Again I am not a doctor, but I believe the fatty liver is important information. If Dr. McMullen didn’t want to treat the fatty liver, should could have at very least add the diagnoses to my medical records for other doctors that may provide me with medical services.*11/8/2022 there were 2 medical record issues. The 1st issue is with the

Pantoprazole. Dr. McMullen changed my dose from 1 40mg per day to 1 40mg 2x per day. She doubled my dose because I again complained to her about stomach pain. The dosage change on this day is in my medical records as a note, but the actual prescription change wasnt done in my medical records. I was taking 2x pills a day, but my medical records only showed that I was taking 1 pill per day. This medication information stayed incorrect for a really long time in my medical records. I believe for more than a year that my medications were not listed correctly. *On the same 11/8/2022 medical record, I found that Dr. McMullen says that she ordered blood test, specifically: Thyroid stimulating hormone, comprehensive metabolic panel and CBC with Auto Differential. _ I have no idea why Dr. McMullen put that she ordered these blood test, because she did not. I did not do any blood test for this office visit. Dr. McMullen did refer me to do a sleep study on this day for fatigue. _ I don’t have any proof of this but I believe that Dr. McMullen said she ordered the blood test on this day, so my health insurance would cover the sleep study referral. I did not ask Dr. McMullen for any kind of sleep study, it was her recommendation for me always being tired. “chronic fatigue”.

*On 7/16/2025 Dr. McMullen illegally changed my medical records to include a diagnoses of “Bacteremia due to Escherichia coli” Before the 7/16/2025 clinic appointment. I texted McMullen on 7/14/25 and told her that my symptoms were consistent with bacteria infection. See Image (TMB8) for proof of this She replied telling me that she can have my blood and urine tested on the 7/16/2025 visit. She did order many blood test during the 7/16/2025 visit. When the visit was ending, I asked her about the urine test. She told me that I didn’t need to have my urine tested because the blood test would show everything. So no urine sample was taken and I have lots of blood for testing. I was sent home.

On 7/17/2025 the very next day I had some kind of attack around noon. I slept off a bit of the attack and sent Dr. McMullen a text explaining the moments of the attack. (Image attached TMB3) She responded letting me know that she still didn’t know what was wrong with me and to wait for labs. She did not request, suggest or recommend that I see an emergency doctor about the attack, I decided to go because I was getting worse and nobody at UT Health was helping me.

I told her that I wasn’t feeling well and that I was going to the emergency room at Dallas Presbyterian hospital. When I arrived at Presbyterian hospital ER the doctor took more blood test and urine test. This doctor also ordered cultures to be tested. The ER doctor prescribed me with a UTI. I received some IV antibiotics during the ER visit and the doctor wrote me a RX for oral antibiotics. The next day 7/18/2025 Presbyterian hospital called me and told me that I had bacteria in my blood and that it was important that I get to an emergency room asap for urgent care. So I was admitted into UT Health East Texas Athens hospital for 3 days of IV antibiotics.

Dr. McMullen added the “Bacteremia due to Escherichia coli” diagnoses to the 7/16/2025 medical record after my diagnoses on 7/18/2025 to cover up that she couldn’t identify the infection. Its illegal for a doctor to change medical records to cover up malpractice _ and that’s exactly what she was doing. When I turned her in to the hospital for not being able to identify an infection _ she lied to the hospital and said that the urine sample the clinic collected that day was lost and thats why my urine was not tested. No urine was taken and that’s why no urine was tested.

* On 7/23/2025 I went in for a follow-up after my 3 day hospitalization for bacteria in my blood. Instead of an actual medical record, Dr. McMullen used this as an opportunity to document her statements and excuses for almost killing me. I have attached a screenshot of Dr. McMullen’s statements and excuses to this email labeled as (TMB4). These are the doctors exact comments After last visit 7/16/25 next day was working and suddenly teeth started chattering, had some sharp back pains. MRI done 4/3/25 not fully explain symptoms, exam. So further evaluation planned. Pt pending with neurology , but earliest appt is 10/27/25!!. EMG/NCV still pending scheduling

Also had been c/o random muscle fasciculations all limbs, trunk, and difficulty with coordination, walking at times I.e. like would fall backwards, weakness, fatigue, numbness, tingling of limbs intermittently, joint pains . So also was pending MRI Brain for 8/4/25. Due to all this had extensive lab drawn am of 7/16/25 from us. CBC normal, CMP ok. ANA negative, RPR negative, CCP/RF, Lyme negative. Parvo = c/w prior infection. Crp, Esr mildly elevated, hgaic 5.4%, tsh ok. Vitamin D was low 2 31, B12, magnesium ok”

These are the actual FACTS that Dr. McMullen is trying to excuse in her statements in this medical record. My teeth chattered 1 time on 7/15/2025 and I told Dr. McMullen when it happened. She did note it in my medical record on 7/16/2025 _ so for this medical record she lied and said that the teeth chattering happened the day after 7/16. I did have sharp pains after 7/16 visit, but I had plenty of those sharp pains prior to 7/16 and I did tell McMullen about them and I asked her for medical help. Pain is listed as a reason for most of my clinic visits with Dr. McMullen, there is nothing “Transient” about the pains. Then she says that that evening I got fever, chills and went to Kaufman hospital and diagnosed with UTI. Dr. McMullen pulled the information she wanted to out of the text messages I sent her describing the attack and tried to use it as an excuse. The attack happened around lunch time and I texted McMullen at exactly 2:17pm describing the attack. She responded to my text saying the information didn’t help with the diagnosis and to wait for lab results. (see attached screenshots) There was no fever, I had been weak for a long time, I went to Presbyterian in Dallas before the sun set for the day not Kaufman that evening. Presbyterian hospital did call me on 7/18 telling me I had bacteria in my blood and to get to ER ASAP for treatment, but I did not go to UTA as McMullen wrote in this record. I went to UT Health Cedar Creek Lake ER and that just happens to be the hospital where McMullen’s clinic is located. Dr. McMullen was working on the other side of the hospital while I was in the ER. Then that hospital transferred me to UTA for inpatient care. “Follow up blood cx negative” That testing was done by UTA not by Dr. McMullen. Of course I did feel much better after receiving the antibiotics and goes on to say “Never had classic uti symptoms” I’m not a doctor, but the ER doctor at Presbyterian didn’t seem to have any problems with suspecting infection, he did order the test after a short 10 min ER talk. That doctor looked to be in late-20s-early-30s and he was bouncing around the ER like he was at a party – I have no doubt that this young doctor was a excellent doctor, but there way that this doctor had some kind of majestic healing powers that enabled him to identify the infection in minutes while Dr. McMullen couldn’t do it in the months she had to treat me. Dr. McMullen then list almost every symptom that I described to her, as if she was trying to excuse why she didn’t catch that UTI. Her notes say that I received and MRI on 4/3/25 _ I did not receive a MRI on 4/3/25. If she believes I received a MRI on 4/3/25, just ask to see the dated report. On 4/3/25 I received blood testing that identified a magnesium deficiency. 4/3/25 also happens to be the clinic visit that McMullen sent the neurology referral. Then there is the “Due to all this had extensive lab drawn am of 7/16/25 from us”  Dr. McMullen is saying that she ordered all of those blood test, EMG and MRI because of my symptoms. This is NOT TRUE. Dr. McMullen told me that she didnt know what was wrong with me and that I needed to wait for the neurologist appointment because she couldnt identify the issue. Dr. McMullen ordered all of those blood test, EMG and MRI because I told her that she was withholding medical treatments. She told me that she didn’t know I was so I’ll because she thought I was running up and down stairs as a delivery driver. I told her that she was mistaken and that she was denying me with much needed medical care. I was angry that I had been suffering with pain for months waiting for a neurologist because my doctor that I was trusting with my life said she didn’t know what was wrong and she had done everything she could. Then I found out that my doctor that I trusted didn’t even think I was sick. When I started telling her that she was withholding medical treatments because I was a delivery driver _ it was when she ordered all of the test. see the image labeled (TMB9) and (TMB10)

*Dr. McMullen prescribed to me Pantoprazole on 2/8/2022 without the drug even being medically necessary. Dr. McMullen had no medical reason to Pantoprazole at all. Completely unnecessary, and she wrote it in the visit notes herself as following “Does have gerd, but that is fairly well controlled with medications, diet.” During this very same clinic visit she wrote me a prescription for “pantoprazole (PROTONIX) 40 mg EC tablet, Take 1 tablet (40 mg total) by mouth 1 (one) time each day., Disp: 90 tablet, Rfl: 3“. I was not given much of any information about the Pantoprazole. I thought it was just a once a day pill to not need to take tums at night. I believe this information is significant, so I will include screenshot of this part of my medical record with this email. The screenshot will be labeled as (TMB2)

Something happened to my body when I started taking the Phentermine. I’m not a doctor, so I don’t know how to explain it in medical terms for the medical board. I did go into details with my doctors at the time. I was told by Dr. McMullen that she didn’t know what was wrong with me _ but it wasn’t the Phentermine. Then I was told that I need to see a neurologist because I had some kind of nerve disease, but I had to deal with the symptoms until the neurologist could see me in 6 months. She noted that she took me off the phentermine on 4/3/25 _ she did not. I stopped taking the Phentermine on 4/1/25 because it was messing with my nerves in the leg I had just had surgery on. Her medical opinion was that the Phentermine wasn’t the issue _ so why would she tell me to stop taking it per doctor orders?

I sure did post a Google review for Dr. McMullen. I posted this very specific information as a Google review to put an immediate stop to Dr. McMullen’s malpractice when it comes to the long-term use of Pantoprazole. I know that as of the minute she read this review_ she will be thinking about all of her patients that are currently taking Pantoprazole. I bet she is looking closely at each of those patients and probably ordering a bunch of test to check for deficiencies. I also think she will have 0 issues with identifying a UTI that was caused by a thiamine deficiency. See attached image (TMB7)

I like to think that this Google review will help other patients in pain and possibly save someones life.

So Where Is The Texas Medical Board Lack Of Supporting Evidence?

Very hard to believe that the supporting evidence that I turned in on February 5, 2025 wasn’t enough for at a bare minimum as least an investigation. Remember, I attached 12 different supporting documents including the 2 attached to this article with all of the details.

As of March 26, 2026 this complaint was closed due to “Lack of Supporting Evidence” by the Texas Medical Board.

My personal opinion of the Texas Medical Board actions are – THAT THEY REALLY DONT HAVE STANDARDS FOR DOCTORS!!!

  • Its completely fine for medical records to be tampered with.
  • 100% ok to deny medical treatment

I did prove these facts with supporting evidence – so it MUST be within Texas Medical Boards standards.
